Terms & Conditions

We love to welcome guests to The Linhay in our magical valley at Butterhills and to share its peace and tranquility with them. Our Terms and Conditions are to protect us and you, the guest and your party, so please read and adhere to them. By paying your deposit, you are agreeing to the terms set out below:

PAYING FOR YOUR HOLIDAY

Bookings may be made online, by telephone or email and must be followed by the required payment and, if applicable, a completed booking form signed by the lead guest who must be over the age of 18 and authorised to accept the terms and conditions by all persons named.

We require a deposit of 25% of the total holiday cost which must be received by us within 24 hours to confirm your booking unless agreed otherwise. If we do not receive your payment we reserve the right to release your reservation and we will not be able to guarantee that the accommodation will subsequently be available.

The deposit of 25% is non-refundable.

If your holiday is less than 8 weeks away when booked then the full amount is due on booking.

Payments must be made in Sterling and our preferred method is by card via Stripe – we can email a secure payment link to you or take card payment over the phone. We can also accept cheques (payable to Caroline Welch) or bank transfer.

The balance of your holiday payment is due eight weeks before the first day of your planned holiday. We will endeavour to send you a reminder but it is your responsibility to ensure the balance payment is made by the due date. In the event your payment does not reach us by the said date we reserve the right to re-let the property concerned and in such circumstances you are asked to refer to the section entitled “Cancellation by you”.

CANCELLATION BY YOU

In the event of cancellation by you the following charges become applicable:

Cancellation more than 8 weeks prior to arrival date – 25% of full cost

Cancellation less than 8 weeks prior to arrival date – 100% of full cost

You are strongly advised to take out holiday cancellation insurance to cover this eventuality.

CANCELLATION BY US

In the unlikely event of us cancelling your holiday then we will refund in full any monies paid.

Please note, we cannot be held liable for any consequential loss you may suffer or to reimburse any incidental expenditure incurred.

ARRIVAL AND DEPARTURE

The earliest time of arrival is 3pm and the latest time for departure is 10am. Although we try to be as flexible as we can, this time is required to clean and service the accommodation.

 

GUEST OBLIGATIONS

The supervision of children, dogs and any adults requiring care remains your responsibility at all times. Due to issues of safety the Linhay is not suitable for children under 5 years old.

Please leave the Linhay in a tidy condition and let us know about any breakages so that we can replace them. Any articles damaged or broken beyond normal wear and tear must be paid for. We reserve the right to levy a cleaning charge should the condition of the property make this necessary.

Do not to allow the property to be occupied by more than the maximum number of persons stated.

Please ensure you take all due care in the Linhay, on the farm, and surrounding land and be responsible for your own safety at all times.

Dogs must not be left unattended in the Linhay at any time. They should be flea treated & wormed prior to arrival and kept under control in our grounds at all times.

Smoking is not permitted in any part of the Accommodation and the guest and any member of his or her party agrees not to smoke inside the Accommodation.

COVID19

If you or any of your guests should fall ill during your stay and are displaying symptoms of Covid19 you must inform us immediately. We ask that you all vacate the Linhay and go home as soon as you can, even if this is before the end of your stay as it is not a safe or practical place to self-isolate when unwell. No refunds will be due in these circumstances.

RIGHT OF ENTRY

The owner requires reasonable access to the property during your stay if it is deemed necessary; and in an emergency this may be without notice.

OUR LIABILITY

We, the owners shall not be liable to you or any members of your party for any loss or damage to person or property howsoever caused.

COMPLAINTS AND CONCERNS

Please make us aware of any complaints or concerns as soon as is reasonably possible in order to give us a chance to rectify the situation. In every case a complaint must be notified before departure. We cannot accept complaints notified after departure.

All reasonable efforts have been made to ensure that descriptions given to you in relation to the Linhay are accurate. You acknowledge that minor differences may arise between photographs, descriptions and illustrations and the actual property. If you have any specific requirement you are advised to confirm that requirement with us prior to booking.

RIGHT TO REFUSE

We may, at our discretion, refuse any booking.

If in our opinion any person is not suitable to continue their occupation of the Linhay because of unreasonable behaviour, damage or nuisance to other parties, the contract may be discharged and we may repossess the property immediately. You will remain liable for the whole cost of hire and no refund shall be due.

All personal and other information and details collected by Butterhills Escapes in the course of its business belong to us, and will not be disclosed to any third party. If you wish to be removed from our marketing lists, please contact us. Please see our website for our full privacy policy or contact us for a copy.

ELECTRIC VEHICLE CHARGING POLICY
1.    About this policy
1.1    This policy sets our how Electric Vehicles (EV) should be recharged while at the Property and the responsibilities of EV owners in respect of safe charging.  
1.2    Any reference to "Property" in this policy is a reference to the Property including any garden, grounds, outbuildings, garages or communal spaces. 
1.3    This policy forms part of our contract with you. A breach of this policy will constitute a breach of the contract between us. 
2.    Who does this policy apply to?
2.1    This policy applies to all members of the Booking Party and such other visitors of the Property. It shall be the responsibility of the Lead Guest to inform all members of the Booking Party and any visitors of this policy. 
3.    What is an Electric Vehicle? 
3.1    For the purpose of this policy an EV is any vehicle that uses electric motors, either fully or partially, to drive its wheels. It will derive some or all its power from rechargeable batteries which requires connection to the electricity grid (plug-in). This includes fully chargeable and plug-in hybrid cars, motorbikes, buggies, scooters, mopeds, bicycles, utility vehicles and tracked vehicles.   
4.    Domestic chargers are not permitted at the Property
4.1    Most EVs are supplied with a domestic charger, commonly known as a 'granny charger' or a ‘trickle charger’. These cables recharge the EV using a domestic power source via a 3-pin wall socket. 
4.2    Domestic chargers are not suitable for use at the Property and will create a fire hazard. The use of domestic chargers is strictly forbidden. 
4.3    We retain the right to carry out reasonable inspection, on a without notice basis, to ensure that granny chargers are not in use at the Property. 
4.4    You are solely liable for any damage or loss suffered by us as a result of your unauthorised use of domestic chargers.     
5    We do not have on-site charging facilities at the Property and you must make your own arrangements for EV charging. The closest charge points to the Property are…
